O R D E R

% 15.05.2017 Crl.M.A.No. 712/2017 On 13th January, 2017, this Court had observed, as under:- "Crl.M.A. 713/2017 Exemption allowed, subject to all just exceptions. Bail Appln. 58/2017 & Crl.M.A. 712/2017 By the present petition, the petitioner seeks anticipatory bail in case FIR No.200/2016 under Sections 408/420/467/471 IPC. The allegations of the complainant in the FIR are that she was running a petrol pump in the name of Usha Speed Ways and had kept different workers for the same, of which one was Santosh Maurya, the present petitioner. The petitioner was working as a salesman and his nature of work was of collecting cash after filling the petrol. The petitioner along with others was also responsible for the day to day affairs of the pump. Later on, on checking the accounts it was found that the petitioner and other co-accused

have cheated the complainant and a total sum of ₹3.25 lakhs had been misappropriated.

After some arguments, learned counsel for the petitioner on instructions from the petitioner, who is present in Court, states that the petitioner is willing to hand over a sum of ₹1.13 lakhs allegedly misappropriated to the complainant within one month and will also withdraw his complaints before the Labour Court.

In view of the statement of the petitioner, who is present in Court along with learned counsel, list the present petition on 13th February, 2017.

Till the next date of hearing, no coercive action shall be taken against the petitioner, subject to his joining the investigation as and when directed by the investigating officer.

Learned APP states that the promised amount in terms of the above said order has since been paid. He also submits on instructions from the SI Nagender Nagar, P.S.Sarita Vihar, who is present in Court, that neither any recovery is to be effected from the applicant nor is the applicant required for any further investigations. Keeping in view the totality of the facts and circumstances, it is directed that in the event of arrest of the applicant, he shall be released on bail on his executing personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the concerned I.O/SHO.
