Learned counsel for the petitioner submitted that apart from the other formal witnesses only one public witness is required to be examined.

Learned APP for the State, on instructions, submitted that the respondent shall positively examine the said public witness on the next date of hearing before the Trial Court.

Learned counsel for the petitioner submitted that he may be allowed to withdraw the bail application with the liberty to move fresh bail application before the Trial Court after the examination of the said public witness. Accordingly, the bail application is dismissed as withdrawn with the liberty as prayed for. Pending application are also dismissed as withdrawn. The Trial Court is directed to expedite the proceedings.

It is clarified that this Court has expressed no opinion on the
merits of the bail application.
