Petitioner seeks quashing of the final order dated 21.01.2026 passed by the learned District Magistrate (South) under Sections 164/165 of BNSS, 2023 (corresponding Sections 145/146 of Cr.P.C.). 2.

Learned counsel for respondent No.2 (applicant before the abovesaid Authority) appears on advance notice.

However, after hearing arguments for some time, learned counsel for the petitioner submits that the petitioner would rather file a Revision Petition before the Court of Sessions and, therefore, without prejudice to his rights and contentions, the petitioner does not press the present petition, at this juncture. 4.

He also, however, submits that in order to enable the petitioner to approach the Revisional Court, the impugned order be kept on hold for a period of one week from today.

as not pressed.

All the rights and contentions of the parties i.e. of the petitioner, as well as of the respondent No.2, are left open.

The impugned order would remain on hold for a period of one week from today. However, no special equity would flow in favour of petitioner, merely, because of the above.

Once any such Revision Petition is filed, the Revisional Court shall make best endeavor to dispose of the same as expeditiously as possible. Needless to say, both the sides shall render their due cooperation and assistance to learned Revisional Court to achieve the disposal of the case. 9.

The petition stands disposed of in aforesaid terms. 10.

Nothing contained in the present order shall be taken as an expression over the merits of the case.

Pending applications also stand disposed of.
