By virtue of the present petition under Sections 528 and 529 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks setting aside of the impugned order dated 21.01.2026 passed by learned JMFC (Mahila Court), Patiala House Courts, Delhi in Ct. Cases No.237/2023 titled 'Priti Saraf Vs. Umesh Saraf'. 2.

After some arguments, and in view of the categoric provisions of Section 29 of the Protection of Women from Domestic Violence Act, 2005, learned counsel for the petitioner seeks to withdraw the present petition with liberty to approach the appropriate Sessions Court, in accordance with law.

Learned counsel for the petitioner also submits that considering the urgency involved, he would in the interest of justice, request the concerned Sessions Court to pass appropriate orders at the earliest possible opportunity.

To this, learned senior counsel appearing for the respondent on advance notice submits that considering the nature of the proceedings involved and the past history, there is no occasion for the petitioner to seek any urgent relief.

As such, the present petition, alongwith the pending applications, is dismissed as withdraw with liberty as prayed for.
