Learned counsel for the parties' state that the parties have executed a settlement agreement dated 15.10.2024 before Delhi High Court Mediation and Conciliation Centre, Delhi High Court, Shershah Road, New Delhi ['Samadhan'].

It is stated that as per the terms of the agreement, the plaintiff has agreed to pay a sum of Rs. 1,77,60,000/- in full and final settlement with the defendant.

It is stated that the said amount stands paid to the defendant and in lieu thereof, defendant has issued 'No Objection Certificate' ('NOC') in favour of the plaintiff. It is stated that parties have also undertaken to withdraw all the pending litigation filed against each other, details whereof are set out in the settlement agreement.

Learned counsel for the plaintiff states that plaintiff is present in person and in view of the settlement, entered on 15.10.2024, the plaintiff seeks liberty to withdraw the present suit in terms of the settlement agreement.

Learned counsel for the defendant states that except the criminal proceedings initiated under Section 340 Cr.P.C., which is next listed on 10.12.2024 all other litigation stands withdrawn by the defendant. He states that the defendant undertakes to withdraw the said pending criminal proceedings on or before 10.12.2024.

In view of the aforenoted facts, the present suit is dismissed as withdrawn in terms of the settlement agreement dated 15.10.2024 arrived between the parties.

In addition, at the request of the plaintiff and in view of the settlement arrived between the parties through Mediation, the registry is directed to refund 100% court fee to the plaintiff as per Section 16 of the Court Fee Act, 1870.

8.

Pending application stands disposed of. Interim orders, if any, stand vacated.

9.

All future dates stand cancelled.
