The petitioners have filed the present petition impugning the order dated 28.04.2023 passed by respondent no.1, whereby the daily allowance to the members of the Town Vending Committee (TVC) "who do not hold any office of profit", was fixed at the rate of Rs.300/- for each day on which the TVC member attends a meeting. The impugned order further provides that the daily allowance payable to the TVC member in any month would not exceed Rs.3,000/-.

The petitioners contend that the remuneration fixed for TVC members is minimal and not commensurate with the responsibilities discharged by the TVC members. Although it does appear that the allowance fixed is not very high, it is relevant to note that the post of a TVC member is an honorary post; it is not a post entailing full-time employment.

allowance fixed is amenable to judicial review within the framework of Article 226 of the Constitution of India.
