The present Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 read with Section 482 Cr.P.C. has been filed by the Petitioners seeking quashing of FIR No. 092/2021, under Sections 498A/406/34 IPC, registered at Police Station North Rohini, Delhi. 2.
It is submitted that marriage between Petitioner No.1- husband and Respondent No.2- wife was solemnized on 11.11.2016 as per Hindu rites and a child was born on 05.12.2019. Due to marital disputes, parties started living separately since 24.08.2020.

The Parties have reconciled their disputes with the assistance of family and friends in terms mentioned in Settlement Agreement dated The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 24.05.2024. It is agreed between the parties that Petitioner No.1 shall pay a sum of Rs.80 Lacs to Respondent No.2 towards full and final settlement and parties shall withdraw all the cases/ complaints registered against each other.

It is submitted that parties have already obtained divorce by mutual consent and Decree of Divorce has been granted by the learned Family Court on 12.11.2024.

Respondent No.2 submits that she has received the entire settled amount and she has no objection to quashing of FIR in question. 6.
In view of the fact that Petitioner No.1 and Respondent No.2, who is the Complainant of FIR in question, have amicably settled their disputes and decree of divorce dated 12.11.2024has already been granted by the learned Family Court, no fruitful purpose would be served in continuing with the proceedings arising out of FIR in question. 7.
Accordingly, FIR No. 092/2021, under Sections 498A/406/34 IPC, registered at Police Station North Rohini, Delhi and proceedings emanating therefrom against the Petitioner, are hereby quashed. 8.
It is made clear that the settlement is inter se the Petitioner and Respondent No.2 and is without prejudice to the rights of the child. 9.
The present Petition and pending Application are accordingly disposed of.
