This is an application seeking to set aside the impugned order dated 05.10.2021 passed by the learned MM, Patiala House Court, New Delhi in CC No. 1011/2017 titled 'Satyadev Yadav v. Prashant Kumar', wherein the complaint against the respondent under Section 138 of the Negotiable Instruments Act was dismissed-in-default for non-appearance and nonprosecution. 2.

On 13.10.2023, the petitioner was granted another opportunity to take steps for service of the respondent. As per office report, no steps have been taken by the petitioner. There is no appearance on behalf of the petitioner today.

For the said reasons, I am of the view that the petitioner is not interested in pursuing the application. Hence, the application seeking grant of leave to appeal is dismissed.
