By way of the present petition, the petitioner assails an order dated 12.11.2025 passed by the learned Magistrate in Complaint Case No. 4958/2020, filed by the complainant [respondent herein], as well as the order dated 05.01.2026 passed by the learned Sessions Court in CRL.M.C. 917/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. CRL.REV.P. 606/2025. By the impugned order dated 12.11.2025, the learned Magistrate dismissed the application under Section 311 of the Code of Criminal Procedure, 1973 ["CrPC"], filed by the petitioner herein. The said order was affirmed by the learned Sessions Court vide order dated 05.01.2026, holding that the revision petition was not maintainable against an order rejecting an application under Section 311 of CrPC, and also on merits.

After some arguments, Mr. Pritish Sabharwal, learned counsel for the petitioner, seeks permission to withdraw the present petition, without prejudice to the petitioner's rights and contentions at any subsequent stage of the proceedings before the learned Magistrate's Court or any other forum, in accordance with law.

The petition is accordingly dismissed as withdrawn in terms of the above submission.

It is made clear that this Court has not expressed any opinion on the merits of the matter.
