The present petition has been filed seeking anticipatory bail in connection with FIR No.0010/2024 under Sections 467/468/471/447/120B/34 IPC registered at P.S. Shahbad Dairy, Delhi. 2.

The case of the prosecution and the submissions made by the learned senior counsel appearing on behalf of the petitioner have already been noted in the previous order dated 09.02.2024.

of the disputed property. The petitioner/accused claims that the said property falls in Khasra No.313 whereas the case of the prosecution is that the property is comprised in Khasra No.314 and 316. 4.

Needless to say that the question as to in which khasra number the disputed property falls can be resolved only by way of demarcation of the property. In the backdrop of the aforesaid circumstances, the State was directed to file a status report. The said status report has been filed and the same is on record.

A perusal of the status report shows that the IO concerned has written a letter to the SDM Alipur for demarcation of land to resolve the controversy related to khasra number. Insofar as the allegation that the documents have been forged by the petitioner, the status report reveals that the ownership documents have been verified by the State and the sale deed was also got verified from the concerned Sub-Registrar Office, Mumbai and the same was found to be genuine.

In view of the above, it is directed that in the event of petitioner's arrest, he be released on bail subject to his furnishing a personal bond in the sum of Rs.50,000/- and a surety bond of the like amount to the satisfaction of the SHO / Arresting Officer, further subject to the condition that he will join investigation as and when directed by the IO concerned. 7.

The petition stands disposed of.
