This is a petition filed under section 438 of Code of Criminal Procedure, 1973 seeking grant of anticipatory bail to the petitioner in the event of arrest in FIR No. 61/2023, dated 12.05.2023, registered at PS - Cyber Police Station North, Delhi under section 420 IPC, 1860. 2.
The facts are that the accused in conspiracy forged certain documents for obtaining a property on rent and thereafter duped the complainant by inducing him to deliver laptop tables as well as stools worth Rs. 3,00,640/- at the rented premises. The accused absconded after delivery without making the payment.

It is stated that the petitioner is falsely implicated in the present case and there are no allegations against the petitioner in the FIR. The petitioner has only been named in the disclosure statement by one of the co-accused persons.

On 06.02.2024, this court after considering the said allegations granted interim protection to the petitioner subject to the petitioner joining the investigation.

I am informed that the petitioner has joined the investigation and further undertakes to join the investigation as and when called by the Investigating Officer (IO). All other co-accused persons in the present FIR have already been granted bail.

For the reasons noted above, the petition is allowed and the petitioner shall be released on bail in the event of arrest in FIR No. 61/2023, dated 12.05.2023, registered at PS - Cyber Police Station North, Delhi under section 420 IPC,1860 subject to the following terms and conditions: i.
The petitioner shall furnish a personal bond in the sum of Rs. 20,000/-, to the satisfaction of the concerned Investigating officer (IO);
ii.
The petitioner shall join the investigation as and when called by the IO and shall fully cooperate with the same iii.
The petitioner shall provide his mobile number to the IO concerned, which shall be kept in working condition at all times. The petitioner shall not switch off, or change the same without prior intimation to the IO concerned;
iv.
The petitioner will furnish his permanent address to the IO and in case he changes his address, he will inform the IO concerned; v.
The petitioner shall not leave the country without permission of the concerned Court and if the petitioner has a passport, he shall surrender the same to the IO;

unlawful or that would prejudice the proceedings in pending cases, if any.

The petition is disposed of accordingly.
