% 12.02.2018 Learned counsel for the petitioner submits that petitioner has not been named in the FIR and it is the co-accused persons, namely, Om Prakash @ Tinku, Manish, Subhash, Vipin and Deepak who have been named it the FIR. The name of the petitioner has surfaced only in the statement under Section 161 Cr.P.C. of the injured persons, namely, Mukesh and Anil. It is further submitted that injured persons have not alleged that petitioner was armed with any weapon and had assaulted the deceased or injured. Petitioner is in custody for the last two and a half years. Keeping in mind the facts and circumstances of the case as detailed above more particularly that role of stabbing has not been assigned to the petitioner, petitioner is admitted to bail subject to his furnishing a personal
bond in the sum of `10,000/- with one surety in the like amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms. Dasti.
