% 17.07.2017 The petitioner is confining his prayer; submission is that the writ petition(along with the requisite documents which had been furnished to the Department in August 2016) be answered in accordance with law. On advance notice, learned counsel for the respondent has put in appearance. Her submission is that time had been granted to the petitioner way back in 2014 to file requisite necessary documents; on the failure of the petitioner to file documents, the respondent was constrained to pass the impugned order dated 21.07.2014. If at all the case of the petitioner has to be considered, it should be subject to costs.
Contention of the petitioner is that he has received the payment certificate only in August 2016 which is the necessary document
which has to be filed by the petitioner before the Department. Noting these contentions and counter contentions of the parties, the respondent shall re-examine the case of the petitioner on the basis of the documents now submitted by him in August 2016. This writ petition, accordingly, be treated as representation qua the petitioner. The respondent shall answer the averments made in the petition within an outer limit of three months from the date of receipt of this order.
Petition stands disposed of.
