An affidavit of Sh. Pramod Kumar Agarwal, the Director of the respondent no.1's company, affirmed on 4th March, 2025, has been placed on record. The said affidavit broadly details the terms of the settlement arrived at between the parties.

In terms of the settlement, the respondents have undertaken not to conduct the business or deal with any products bearing the mark 'SUPERIOR 50000'.

Accordingly, the present petition is allowed and a direction is issued to the Trade Mark Registry for cancelling the registration of the impugned trade mark dated 16th April 2001, registered via registration no.1003537. 4.

The Registry is directed to send a copy of this order to the Trade Marks Registry on email llc-ipo@gov.in for compliance. 5.

All pending applications stand disposed of.
