This writ petition is preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "I. Issue a writ, order or direction in the nature of MANDAMUS or any other direction thereby to respondent no. 1 to 3 to stop the illegal and unauthorized construction being carried by respondent no.4 to 6 at the subject property No.F 547, Block-F, Khadda Colony, Jaitpur Extn-II, Badarpur, Delhi-44 which is situated at khasra no.728, measuring 50 sq yards and further directing the respondent no.1 to remove encroachment and demolish the illegal and unauthorized structures already constructed on the property in question.

II. Issue writ in nature of Mandamus and to pass orders and direction against the respondent no.4 to 6 to not to commit any violation of the provision of Municipal corporation Act, 1987 and building by laws therein. The direction may be issue to respondent no.1,2 and 3 to take appropriate action and register the criminal case against the respondent no.4 to 6 against the unauthorized illegal construction, which they are carrying out over the suit property"

This writ petition was listed on 30.01.2025 and was passed over twice but there was no appearance on behalf of the Petitioner. 3.

None appears on behalf of the Petitioner even today. 4.

It appears that the Petitioner is not interested in prosecuting the writ petition and the same is accordingly dismissed in default, recording the statement on behalf of the Special Task Force that complaint has been registered at the behest of the Petitioner on receipt of advance copy of this writ petition and has been forwarded to MCD for appropriate action. 5.

Documents in this regard have been handed over in Court and are taken on record.
