O R D E R

% 12.02.2026 W.P.(CRL) 408/2026 By way the present petition filed under Article 226 of the Constitution of India, the petitioner seeks parole on the ground that his niece is scheduled to get married; and the wedding ceremonies are to commence from 15.02.2026.

Notice on this petition was issued on 04.02.2026. 3.

Verification report dated 09.02.2026 has been filed by the State. 4.

Mr. Rahul Tyagi, learned ASC (Criminal) appearing for the State has handed-up a copy of a Status Report dated 11.02.2026 alongwith the petitioner's Nominal Roll dated 06.01.2026 and other relevant documents, relating to the petitioner's jail conduct and other criminal implications. The same are taken on record.

'satisfactory'; and though his overall jail conduct is recorded as 'unsatisfactory', the nominal roll also shows that he has suffered prison punishments to atone for those infractions. 6.

It is fairly submitted that though the petitioner was also convicted in 02 other cases, he has already undergone sentence for those convictions.

Mr. Verma points-out, that as would be seen from his nominal roll, the petitioner has been granted interim bail, parole, and furlough on 11 previous occasions.

He submits, that the petitioner requires parole to be present with his family and to help with the marriage ceremonies of his brother's daughter, which ceremonies begin on 15.02.2026 and end on 21.02.2026.

On the other hand, learned ASC appearing for the State submits, that the petitioner had jumped parole on 02 prior occasions, which is why his overall jail conduct has been recorded as 'unsatisfactory'; and that he has also been awarded prison punishments in that regard. 10.

Learned ASC also submits, that the petitioner has availed furlough as recently as from 07.01.2026 to 22.01.2026; and that the niece's wedding is not sufficient ground to seek parole. 11.

Upon a conspectus of the foregoing facts and circumstances, and based on the petitioner's nominal roll and his jail conduct, the considerations that prevail with the court in these proceedings, are the following:

11.1. The petitioner has already suffered more than 19 years of judicial custody;

11.2. Though the petitioner has been guilty of various jail infractions, he has atoned for those by way of prison punishments awarded to him from time-to-time; his jail conduct in the last 01-year has been 'satisfactory'; and he has no pending criminal cases against him;

11.3. Though it is true that the petitioner had jumped parole on 02 previous occasions, however those episodes date back to the years 2012 and 2016, which was a long time ago; 11.4. The SHO, P.S.: Sangam Vihar, Delhi has verified the factum of the wedding of the petitioner's niece, as also the dates of the ceremonies which run between 15.02.2026 and 21.02.2026. 12.

In view of the above, the present petition is allowed, thereby granting to the petitioner -Chander Prakash s/o Durjan Singh - parole for a period of 10 days beginning 14.02.2026 till 23.02.2026, subject to the following conditions:

12.1. The petitioner shall furnish a personal bond in the sum of Rs.10,000/- (Rs. Ten Thousand Only) with 01 surety in the like amount, to the satisfaction of the Jail Superintendent; 12.2. The petitioner shall not leave the State of Delhi except to travel to and from Bulandshaher, Uttar Pradesh for the ceremony scheduled on 15.02.2026;

12.3. The petitioner shall furnish to the S.H.O., P.S.: Sangam Vihar, Delhi a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

12.4. If the petitioner has a passport, he shall surrender the same to the Jail Superintendent;

12.5. The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any; and 12.6. Upon expiry of the period of parole, the petitioner shall surrender before the Jail Superintendent.

The petition is disposed-of in the above terms. 14.

Let a copy of this order be communicated expeditiously to the concerned Jail Superintendent, for information and compliance. 15.

Let a copy of this order be given dasti under the signatures of the Court Master.
