Application under Section 484/485 Cr.P.C read with Section 528 BNSS has been filed for modification of the Order dated 05.03.2025 vide which the Furlough for a period of three weeks has been granted to the Petitioner.

It is submitted in the Application that the bail bond has been directed to be furnished in the sum of Rs.15,000/- with one surety in the like amount. amount be reduced to Rs.5000/-, to be refunded to the satisfaction of the Jail Supreintendent.

The second modification sought in the impugned Order is that as per conditions 10.2, 10.3 & 10.4 the Petitioner has been directed to present himself before the SHO, P.S.Bawana on every Thursday between 11 AM and 11.30 AM, to mark his presence. It is submitted that on grant of Furlough the Petitioner shall be going to reside at his native place in District Mainpuri, P.S.Barnahal. It is, therefore, submitted that the impugned Order be modified to the extent stated above.

Learned counsel for the Respondent submits that the Bond amount may not be reduced, as it has been reasonably fixed by this Court.

Submissions heard and record perused.

In view of the submission that the Petitioner belongs to a poor family, the bail bond and surety bond is reduced to an amount of Rs.5000/- which be furnished to the satisfaction of the Jail Superintendent, instead of Trial Court.

In so far as terms 10.2 to 10.4 are concerned, it is hereby clarified that the Petitioner shall report to SHO District Mainpuri, P.S.Barnahal instead of SHO, Bawana.

The impugned Order is accordingly modified.

Application is disposed of.
