The present writ petition has been filed seeking a direction to respondent/MCD to permit the petitioners to file an application for the regularisation of the property bearing Pvt. No. 9, part of property No. 893-D, Ward No. 8, Khasra No. 1151/3 Min, situated in Abadi of Lal Dora, Village Mehrauli, New Delhi - 110030.

Notice is accepted by counsel appearing on behalf of the respondent/MCD.

Mr. Kapil Dutta, counsel appearing on behalf of the respondent/MCD submits that demolition order against the petitioners' property has been passed on 19th January 2026, after issuing a Show Cause Notice dated 30th December 2025.

It is further stated by Mr. Dutta that a contempt petition, being CONT(CAS) 1288/2025, has been filed to take appropriate action against The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
the aforesaid property of the petitioners. Mr. Dutta submits that in the event the petitioner files an application for regularisation, the same shall be considered by respondent/MCD in accordance with law. 6.
Accordingly, the present writ petition is disposed of with the following directions:
6.1.
The petitioner is directed to file the application for regularisation within one (1) week from today.
6.2.
The said application shall be decided by the respondent/MCD in a time-bound manner, within four (4) weeks from today. 6.3.
At the time of consideration of the application for regularisation of the petitioner, the petitioner shall be called for a hearing and proper directions shall be passed after considering the reply and documents submitted by the petitioner.
6.4.
The petitioner shall comply with all the directions issued by the respondent/MCD, including the removal of any excess coverage and noncompoundable deviations. 6.5.
In case the directions passed by the respondent/MCD are not complied by the petitioner for removal of non-compoundable deviations and excess coverage, the MCD shall be at liberty to take action in accordance with law.
6.6.
It is further directed that during the pendency of the regularisation application, no coercive action shall be taken against the property of the petitioner.

Needless to state that in case, the petitioner is aggrieved by any order passed by the respondent/MCD, the petitioner is at liberty to seek remedies in accordance with law.
