The work which is the subject matter of the petition was awarded to Chapra-Hajipur Expressway Ltd. The same was to take place at ChapraHajipur Section in Bihar. Since the genesis of the dispute which is essential integral and material part of cause of action has arisen outside the jurisdiction of this Court, therefore, merely on the ground that the Head Office of the National Highway is situated at Delhi should not be the sole factor to entertain the instant writ petition by this Court. 2.
The similar position has been taken by the Court in LN Malaviya Infra Projects Pvt. Ltd. v. National Highway Authority of India & Ors1. vide its order dated 14.01.2026. suffice it to say that the same would bind the parties for their contractual disputes.

Mr. Sanjay Jain learned senior counsel appearing for NHAI submits that the Arbitrator has already been nominated by NHAI. If that be so, the Court is not inclined to entertain the instant writ petition only on the ground of territorial jurisdiction and leaves it open to the petitioner to take remedy as may be available in accordance with law.

With these observations, the petition stands dismissed. Pending application shall also stands disposed of.
