Learned counsel for petitioner submits that the application moved on behalf of the petitioner under Order VII Rule 11 read with Section 151 Code of Civil Procedure ("CPC") Order I Rule 10 read with Section 151 CPC and Order VI Rule 17 read with Order VIII Rule 1A of CPC are pending for disposal since last 2-3 months before the learned Trial Court and without disposal of these application recording of evidence of the parties by Local Commissioner is allowed by learned Trial Court. 4.
