Petitioner seeks quashing of order dated 08.01.2026 and praying for suspension of operation of impugned judgment of conviction dated 21.08.2025 and order of sentence dated 29.08.2025. 2.

It appears that the petitioner challenged his conviction under Section 138 Negotiable Instruments Act and the learned Appellate Court suspended sentence, admitting the petitioner to bail subject to deposit of Rs.1,00,000/- within one month. Since the petitioner did not deposit the said amount, he was taken into custody, posting the appeal on 30.01.2026 for arguments. 3.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition with liberty to file appropriate application before the learned Appellate Court. 4.

The petition and accompanying applications are dismissed as withdrawn with liberty as sought.
