The present petitions are filed challenging the separate orders dated 04.01.2025 (hereafter 'impugned orders'), passed in CA No.136/2023, CA No.134/2023 and CA No.133/2023, whereby the learned Appellate Court had dismissed the respective applications filed by the petitioner to compound the complaints after noting the refusal of the respondent to accept the fine amount.

The learned counsel for the respondent, on instructions, states that the fine amount of ₹2.54 lakhs (in each case respectively) was paid by the petitioner on his own will and no settlement was ever arrived at between the parties. She submits that the deposited amounts will be returned to the petitioner. 3.

As rightly noted in the impugned orders, the complainant cannot be forced to accept the fine amount or compelled into consenting for compounding of the offence at the appellate stage. 4.

Considering the above, the respondent is directed to refund the amount received from petitioner directly to the petitioner within a period of four weeks from today.

The petitioner is at liberty to take all his arguments before the learned Appellate Court.

The petitions are dismissed with the aforesaid observation. Pending applications also stand disposed of.
