% 17.01.2018 This petition under Section 11 of the Arbitration and Conciliation, 1996 has been filed by the petitioner seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Settlement Agreement dated 01.01.2016 which contains an Arbitration Agreement between the parties in form of Clause 3 thereof. The learned counsel for the respondent submits that the respondent has no objection to the Court appointing an Arbitrator for adjudicating the disputes that have arisen between the parties. He submits that while appointing an Arbitrator all submissions and contentions of the respondent should be left open.
With the consent of the parties, the parties are referred to Delhi International Arbitration Centre (DIAC), which shall appoint a Sole Arbitrator keeping in mind the nature of claim/counter claim of either of the parties. The arbitration and fee shall be governed by the DIAC rules. The
parties shall appear before the DIAC on 01.02.2018 at 2:00 p.m. The petition is allowed in the above terms.
All claims/counter claims either of the parties left open to be argued of before the Arbitrator so appointed.
