The instant petition under Section 29A(4) and (5) of the Arbitration & Conciliation Act, 1996 has been filed by the Petitioner seeking extension of the mandate of the Sole Arbitrator till July 2026. 2.

Material on record indicates that the Arbitral Tribunal was appointed by this Court on 10.04.2022. It is stated that since the mandate of the Tribunal is going to expire on 28.02.2025, the Petitioner has approached this Court seeking extension of the mandate of the Arbitral Tribunal for making the Award. It is stated that the mandate of the Sole Arbitrator be extended for 16 months i.e. till July 2026 to avoid the parties from coming to the Court for repeated extensions.

Material on record indicates that the mandate of the Arbitrator was extended from time to time and last such extension was granted on 29.02.2024 which now comes to an end on 28.02.2025. 5.

In the facts and circumstance of this case and as requested by both the parties, this Court is inclined to extend the mandate of the Arbitral Tribunal for a further period of 16 months i.e. till 30.06.2026 so that the Award can be pronounced.

The petition is disposed of along with the pending applications, if any.
