This petition has been filed under Article 226 of the Constitution of India read with Section 528 Bharatiya Nagarik Suraksha Sanhita, 2023 [BNSS], seeking issuance of Writ in the nature of Habeas Corpus for production of Mrs. Kumkum, who is aged around 20 years of age.

Mrs. Kumkum has appeared before us in person along with her parents, that is, the respondent no.3 and his wife. 3.

We have interacted with the girl, who admits to have married the petitioner and has expressed her desire to stay with the petitioner. We have counselled the parents of the girl as also the petitioner. 5.

As the girl is a major and wishes to stay with the petitioner, she is at liberty to do so.

In case, the petitioner and the girl apprehend any threat from her parents, they may approach the concerned Police Station for seeking protection. Adequate steps in this regard shall be taken by the SHO of the concerned Police Station.
