The present appeal has been filed under Section 10 of Delhi High Court Act, 1966, read with Section 104 along with Order XLIII Rule 1 of the Code of Civil Procedure, 1908, and other appropriate provisions of the Code of Civil Procedure, 1908, for and on behalf of the appellants seeking setting aside the Judgment dated 13.01.2026 passed by learned Single judge of this Court in Chamber Appeal Bearing O.A. Heard learned counsels for parties.

With the consent of parties, the following order is being passed. 4.
The two of the defendants which are defendant nos. 3 and 5, who are substituted in place of mother, would only get a right to contest the suit, and the said substitution would not amount to declaration of any rights of the said two defendants in the properties of the deceased mother.

Further, it is also clarified that in case, if any Court Fees would be liable to be paid by any of the parties, the same shall be paid by the parties at the stage of execution.
