This application has been filed seeking condonation of five (5) days' delay in re-filing the petition.

For the reasons stated, the application is allowed. The delay in refiling the petition stands condoned. W.P.(C) 1674/2026 5.

The present writ petition has been filed seeking a direction to respondents no.1 to 3 to stop the illegal and unauthorised construction at Khasra No. 407 (Also at H.No. 52), Situated at Village Dera, New Delhi - W.P.(C) 1674/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. It is stated that a civil suit has been filed by the petitioners against the private respondents, being CS (DJ) No.651/2025, which is stated to be pending.

In the aforesaid civil suit, an order has been passed on 24th December, 2025, on an application filed by the private respondents under Order XXXIV Rule 4 of the Civil Procedure Code, 1908, in terms of which the private respondents were permitted to continue construction in the portion of 180 sq. yds.

It is the case of the petitioners that the private respondents are carrying out unauthorised construction under the garb of the said order. 9.

Counsel appearing on behalf of the respondent/MCD on advance notice submits that on the basis of the complaint filed by the petitioners, the aforesaid property has been booked by the respondent/MCD. 10.

In view of the above, no further orders are required to be passed in the present writ petition.

Accordingly, the writ petition is disposed of while directing the respondent/MCD to take appropriate action in accordance with law. 12.

Pending applications also stand disposed of.

Needless to state, all rights and remedies of the private respondents are kept open.

14.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.
