This writ petition has been filed by the Petitioner under Article 226 of the Constitution of India read with Section 482 Cr.P.C. seeking the following relief:- "It is, therefore, prayed that this Hon'ble Court may be pleased to pass appropriate writ of mandamus or any other writ or direction or order under the facts and circumstance of the case thereby directing the respondent no. 1 & 2 to protect the life and liberty of the minor daughter of the petitioner and for providing police protection to the minor daughter of the petitioner from kidnapping by the respondent no. 3 & 4." Learned counsel for the Petitioner expresses a serious apprehension that his minor daughter is likely to be kidnapped by Respondents No. 3 and 4 on account of inter-se disputes between the parties. It is further submitted that the examinations of the girl child are starting soon for which she will need to go out of the house and therefore, protection be granted so that no untoward incident occurs.

Learned ASC accepts notice on behalf of the State and without entering into the alleged disputes between the parties and for the safety of the girl child, fairly, states that the mobile numbers of the Beat Constable and the SHO of the concerned area shall be provided to the Petitioner during the course of the day albeit they have been provided earlier and in case any help or assistance is required, Petitioner is free to contact on those numbers. On account of the forthcoming examinations, it is further stated that the Beat Constable shall visit the house of the Petitioner once in two days till the end of March, 2024, to ascertain the well being of the child, upon the Petitioner furnishing the schedule of the examination.

Petition is accordingly disposed of, taking the assurance given by the learned ASC on record, with a further direction that if and when any call is received from the Petitioner, seeking help or assistance, prompt action shall be taken by the concerned Officers.
