This appeal is disposed of as not pressed as counsel for the appellant states that since the mother Smt. Nand Kaur was admittedly a co-owner because the property belonged to her late husband Sh. Nand Singh, and accordingly, even if the appellant is not the complete owner of the suit property, yet, the appellant is the co-owner and hence entitled to partition of the suit property to the extent of the share of the mother which has devolved upon him as also his own share which he inherited from his father Sh. Nand Singh who has died intestate.

This appeal is disposed of as not pressed with the aforesaid liberty to the appellant to file a suit for partition, of course, in accordance with law and also seek any additional reliefs therein. VALMIKI J. MEHTA, J MAY 02, 2017/AK
