Learned counsel for the petitioner submitted that, instead of Rs.1,00,000/-, he may be allowed to deposit a sum of Rs.75,000/- within nine weeks from the date of the order dated 9.9.2019 of the Trial Court and seeks permission to withdraw the petition.

Hence, in view of the submissions made by the learned counsel for the petitioner and in the interest of justice, the order dated 9.9.2019 is modified to the extent that the petitioner, instead of Rs.1,00,000/-, shall deposit Rs. 75,000/- within nine weeks from the date of passing of the order of the Trial Court, dated 9.9.2019.

Accordingly, the petition is dismissed as withdrawn. Pending application is also dismissed.
