The present petition was scheduled to be listed on 03.03.2026; however, it has been taken up today, as 03.03.2026 was declared a holiday vide Notification No. 64/G-4/Genl.-I/DHC dated 27.02.2026. 2.
By way of the present transfer petition, the petitioner has brought to the attention of this Court that two proceedings, arising out of the same cause of action, are presently pending before different Courts. 3.
Respondent No. 2, who is the petitioner's sister, had lodged FIR No. 262/2012 dated 07.11.2012, registered at Police Station Kotla Mubarakpur, under Sections 468/120B/471/420/467 of the Indian Penal Code, 1860 ["IPC"], in which the petitioner is arrayed as an accused, and the proceedings arising therefrom, are presently pending before the Court of JMFC-09, South East District, Saket Courts, Delhi. 4.

registered at Police Station Paschim Vihar East under Sections 385/34 IPC, was lodged by the petitioner against respondent No. 2 and her husband. It is, however, stated that the prosecution has placed both of them in Column 12 of the chargesheet, with no accused shown in Column
11. The petitioner has accordingly filed a protest petition in respect thereof, which remains pending. The proceedings arising of the said FIR are presently pending before the Court of JMFC-11, Tis Hazari Courts, Delhi.

Without prejudice to their respective rights and contentions of the parties on merits, learned counsel for the parties submit that they have no objection if the proceedings pending before the Tis Hazari Courts are transferred to the Saket Courts, where the proceedings instituted by respondent No. 2 are already pending.

Consequently, Complaint Case No. 7020/2019 and Criminal Case No. 3045/2023, arising out of FIR No. 347/2021 registered at Police Station Paschim Vihar East and presently pending before the Court of learned JMFC-11, West District, Tis Hazari Courts, Delhi, are hereby transferred to the Court of learned JMFC-09, South East District, Saket Courts, Delhi.

The transferred case be listed before the transferee Court on 11.05.2026 for further directions.

The transfer petition, alongwith pending applications, is accordingly disposed of.
