The present applications have been filed under Section 438 Cr.PC. seeking anticipatory bail in FIR No.127/2022 registered under Sections 467/420/34 IPC at P.S. Sunlight Colony.

Learned counsel for the applicants submits that the applicants have entered into a settlement with the complainant namely, Rohan Kaushik and in pursuance of the same, have also paid a sum of Rs.15 lacs by way of a demand draft.

The complainant, who is present in the Court, is identified by the Investigating Officer, submits that he has signed the aforesaid settlement and has also received a sum of Rs.15 lacs by way of demand draft. He, however, states that certain other modalities are yet to be worked out. 4.
Keeping in view the aforesaid facts and circumstances and the fact that the parties have already entered into a settlement, it is directed that in the event of arrest, the applicants be released on bail subject to them furnishing personal bonds in the sum of ₹25,000/- each with each surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- (i) The applicants shall join the investigation as and when they are asked for.
(ii) At the time of furnishing bail bonds, the applicants shall provide the mobile numbers, which they undertake to keep operational at all times during the pendency of the trial. (iii) The applicants shall inform the concerned Investigating Officer about their current residential address. (iv) In case of change of residential address/contact detail, the applicants shall promptly inform the same to the concerned Investigating Officer/SHO.
(v) The applicants shall not tamper with the evidence. (vi) The applicants shall regularly appear before the trial Court as and when the charge sheet is filed.
