An application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner / applicant for grant of interim bail in FIR No. 823/2015 under Sections 302/34 IPC registered at PS: Hari Nagar, Delhi.

Issue notice. Learned APP for the State appears on advance notice and accepts notice.

Learned counsel for the petitioner submits that petitioner is required to undertake treatment in a specialized hospital / centre, since he is suffering from fever, weight loss, Jaundice and Tuberculosis (TB) as well as some white matter hypodensity has been revealed in his NCCT report. Medical report dated 03.01.2024, which was considered by learned Trial Court, has been placed on record. The interim bail was declined by learned Trial Court observing that the condition of the petitioner is stable and is being provided with all medications from the hospital. It was further observed that since the accused is facing trial, wherein a convict had been attacked with a improvised knife, there are high chances of the applicant fleeing from the course of justice, in case he is enlarged on bail. 5.
Considering the medical report and the facts and circumstances of the case, no grounds for interim bail are made out. However, Superintendent Jail is directed to get the petitioner examined at Safdarjung Hospital, for purpose of further necessary treatment, if required.
Application is accordingly disposed of.
A copy of this order be forwarded to Superintendent Jail for information and compliance.
