% 01.11.2019 The present petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the petitioner praying as follows:- "a) issue the writ in form of habeas corpus thereby issuing directions to the respondent Nos.1 to 3 to produce the missing daughter of the petitioner namely Aksha before this Hon'ble Court;
b) Pass any other or further order/s, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in favour of the petitioner, in the interest of justice.
Mr. Rahul Mehra, learned Standing Counsel (Criminal) has handed over a status report dated 31.10.2019, authored by Inspector Pavan Kumar, SHO-PS Khajuri Khas, in Court today. The same is taken on record. W.P.(CRL.) 2938/2019
Ms. Aksha, the 22 years old daughter of the petitioner is present before this Court and states that, she has left her parental home of her own free will and desire and does not wish to return thereto. In view of the foregoing statement made on behalf of Ms. Aksha, learned counsel appearing on behalf of the petitioner, on instructions from the latter, does not press this habeas corpus petition.
