% 10.12.2019 This is a petition filed under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of a Sole Arbitrator. Reply has been filed by the learned counsel for the respondent in Court today. The same is taken on record.

From a perusal of the reply, filed by the respondent, it is seen that the respondent is contesting the claim of the petitioner for `27,09,293/- on various grounds. In substance, they do not deny the arbitrability of the dispute which has been raised by the petitioner while invoking the Arbitration clause vide legal notice dated 13th July, 2019. If that be so, there is no impediment in appointment of a sole arbitrator. Accordingly, this Court appoints Justice Shiv Narayan Dhingra, a retired judge of this Court, as a Sole Arbitrator who shall arbitrate the disputes between the parties. The appointment of the Sole Arbitrator shall be regulated by the Rules of the DIAC.

The parties shall be at liberty to take all pleas available both on facts and in law.

The petition stands disposed of.
