The main grievance in this petition is that the Trial Court has proceeded to decide the amendment application under Order VI Rule 17 CPC filed by the respondent twice without adjudicating the application of the petitioner filed under Order VII Rule 11 CPC. According to learned counsel, the application under Order VII Rule 11 CPC was filed much prior to the filing of the amendment applications.

The petition is disposed of with directions to the Trial Court to take up the application filed under Order VII Rule 11 CPC on priority and dispose of the same as expeditiously as possible.
