By way of present petition filed under Section 482 Cr.P.C., the petitioner seeks expunging of remarks passed by learned Special Judge (NDPS)-02, Dwarka Courts, New Delhi in the order dated 12.01.2024 in SC No. 215/2020.

I have gone through the paper book with the help of learned APP for the State.

A perusal of the impugned order shows that on 12.01.2024, the petitioner, who appeared before the trial court to seek adjournment could not correctly convey to the trial court that Mr. Aggarwala had appeared virtually and not physically before the Division Bench of this Court. 5.

The Trial Court was of the view that an incorrect statement has been made as Mr. Aggarwala had appeared through V.C. on that date before it where he could be seen at an airport and thus could not appear physically The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. before the Division bench. Apparently, Mr. Aggarwala appeared before the Trial Court as well as before the Division Bench of this Court through V.C. while he was in the process of boarding a flight from Srinagar to Delhi. 6.

As such, no incorrect statement was made by the petitioner. Considering the aforesaid, the prayer made in the petition is allowed and the remarks made against the petitioner are expunged. 7.

Petition is disposed of in the above terms alongwith miscellaneous application.
