The petitioner has filed the present petition, inter alia, praying that the petitioner be granted bail in connection with FIR No. 0266/2016 under Section 302 of the IPC registered with PS Begum Pur. 2.

The said FIR was registered at the instance of the father of the deceased. He had reported that on 24.03.2016 at about 08.00 pm, he and his son (the deceased) were out on an evening stroll after consuming food. He was walking some steps behind his son. At that stage, his son was accosted by four boys including the petitioner. He had reported that three boys had caught his son and the fourth boy, who was identified as the petitioner herein, had attacked his son with a knife. The complainant had succumbed to the injuries suffered by him.

This Court is informed that the evidence on behalf of the prosecution is closed and the matter is now listed for defence evidence on 30.01.2020.

The petitioner seeks bail in order to prepare for his defence. 4.

Given the gravity of the allegations and considering the stage of the proceedings, this Court is of the view that the petitioner poses a serious flight risk and therefore, it would not be apposite to grant bail to him, at this stage. However, the jail authorities are directed to provide all necessary facilities in order for the petitioner to consult with his lawyer and prepare his defence.
