Present writ petition has been filed primarily seeking a direction to the Respondent No.2-DDA to allot land to Respondent No.1-MCD for the construction of Dhalaos/FCTS/Segregation Centre/Maintenance office for effective disposal of the heaps of garbage in Bhim Basti near University Boundary and Khasra No.1895 near Ambedkar Park, Aya Nagar. Learned counsel for the Petitioner does not wish to press the other prayers at this stage.

Learned counsel for the Petitioner states that the village has a population of more than 1.5 lakh and for the said population, there is only one garbage collection centre which leads to the spillage of garbage in and around the area. According to him, there is a requirement of at least 5 Dhalaos (Garbage collection Centres) in Bhim Basti, near University Boundary and Khasra No-1895 Near Ambedkar Park, Aya Nagar. 3.

Learned counsel for the Petitioner states that for the construction of the Dhalaos/garbage disposal system/FCTS, Respondent No.2-DDA is obligated to provide land and for the same purpose, Petitioner as well as Respondent No.1-MCD has written several letters, however till date no concrete action in this regard has been taken by the Respondent No.2-DDA. 4.

Keeping in view the aforesaid, this Court directs the present writ petition to be treated as a representation to the Vice-Chairman, DDA, who is directed to decide the same by way of a reasoned order in accordance with law within four weeks.

With the aforesaid directions, present writ petition along with the applications stands disposed of. However, this Court clarifies that it has not commented on the merit of the controversy. The rights and contentions of all the parties are left open. Let a copy of this order along with the writ petition be communicated to the Vice-Chairman, DDA by the learned standing counsel for DDA, who is present in Court today.
