% 24.02.2026 Further to what was recorded in orders dated 04.02.2026 and 23.02.2026, Mr. Rahul Tyagi, learned ASC for the State submits, that as was represented in yesterday's hearing, the concerned authorities are ready and willing to treat the parole application filed by the petitioner as an application for furlough, since as per the proviso to Rule 1213 of the Delhi Prison Rules, 2018 the jail authorities are required to first consider releasing a convict on furlough before forwarding any application for parole.

Mr. Tyagi submits, that in fact the option for availing furlough was put to the petitioner earlier, but he declined the same in writing vidé letter dated 18.02.2026 addressed to the jail authorities. A copy of the letter has been handed-up in court. copy of the petitioner's Nominal Roll dated 17.02.2026. Both documents are taken on record.

On the other hand, Mr. Sarthak Maggon, learned counsel appearing for the petitioner submits, that the petitioner would insist on the grant of parole (as against furlough), since parole can be availed for longer than 02 weeks, and the petitioner requires such more time to attend and be a part of his daughter's wedding.

At the same time learned counsel argues that the petitioner needs to be released from custody urgently since the wedding functions of his daughter are scheduled in Bihar from 26.02.2026 onwards. 5.
Be that as it may, without delving further into the matter, and considering the urgency of the petitioner's request, the present petition is disposed-of, with a direction that the petitioner be released from custody on his 3rd spell of furlough for a period of 02 weeks on the same terms and conditions on which he was released on his 2nd spell of furlough vidé order dated 30.12.2025. 6.
It is directed that the documents placed by the petitioner in compliance of those conditions be treated in compliance of grant of furlough by the present order.

Pending applications, if any, also stand disposed-of. 8.
