The counsel for the respondents, in pursuance to the order dated 1st November, 2019 requiring him to obtain instructions, states that there are still 12 vacancies for the post of CT(GD) in BSF against Sports Quota 201718 Aquatic (Swimming/Diving/Water Polo) and no advertisement therefor has been issued.

The counsel for the petitioner states that if the respondents delay issuance of advertisement for filling up the fresh vacancies, the petitioner may be age barred.

However, this Court cannot compel the respondents to take out an advertisement for the vacancies admitted.

The counsel for the petitioner also fairly agrees but has drawn attention to prayer (b) in the Petition.

However, what we have observed hereinabove, of being not in a position to compel the respondents to take out the advertisement for filling up vacancies, would apply to prayer (b) also where the petitioner has sought sympathetic consideration owing to the likely age bar in the event of delay on the part of the respondents to fill the vacancies. 6.
On 1st November, 2019, when the Petition had come up first before this Court, the counsel for the respondents was only asked to obtain instructions and in pursuance whereto response has been recorded today. No further orders are required in this Petition. 7.
The Petition is disposed of.
