Mr. Parag Tripathi, learned Senior Counsel appearing for the petitioner states that without prejudice to the rights and contentions, the petitioner would seek to agitate its grievance before the Arbitral Tribunal. 2.

Mr. Sanjay Jain, learned Addl. Solicitor General, has communicated names of five persons [(i) Justice (Retd.) M. K. Sharma, (ii) Justice (Retd.) S.B. Sinha, (iii) Justice (Retd.) S.S. Nijhar, (iv) Justice (Retd.) G.P. Mathur and (v) Justice (Retd.) R.C. Lahoti] who are acceptable as arbitrator to respondent no.2. The petitioner is now required to select one out of said five names for further steps to be taken for appointment of the arbitrator.

In this view, ad-interim orders passed on 11.01.2013 shall continue for a further period of four weeks from today, to enable the parties to seek their remedies before the appropriate forum.

It is clarified that nothing stated in any order passed in these proceedings shall be construed as an expression of opinion on the merits of the dispute.
