W.P.(C) 303/2018 This petition has been filed by the petitioner challenging the show cause notice dated December 29, 2017 whereby the respondents have proposed to blacklist the petitioner and also asked the petitioner to deposit outstanding dues of Rs.1,22,97,268/- within seven days from the date of issuance of the notice.
It is the submission of learned counsel for the petitioner that the said
notice was received by the petitioner only on January 5, 2018. She concedes to the fact that the reply to the same has not been submitted by the petitioner.
Learned counsel for the respondents states, no final order has been passed on the said notice. He states that respondents are ready and willing to consider the writ petition as a reply to the show cause notice and give hearing to the petitioner, before passing a final order. Noting the submission of learned counsel for the respondents, the petitioner through its representative shall appear before Commercial Officer (Advtt.), SDMC on January 18, 2018 at 2:30 P.M. It is expected that the officer concerned shall pass an order within two weeks thereafter. The same shall be conveyed to the petitioner. If aggrieved petitioner shall be at liberty to challenge the order in accordance with law. The writ petition is disposed of.
