This is an application for interim bail filed on behalf of the petitioner namely Shamshad Bali Mohd. in case FIR No.1044/2024 under Sections 21/25 NDPS Act, PS-Narela Industrial Area.

The learned counsel for petitioner submits that the wife of the petitioner is suffering from epileptic disorder. She has suffered seizures and is on medical care at G.B. Pant Institute. She has been advised various tests including EEG, MRI Barin, CBC/LFT/KFT/SC/LIPID/HBA etc. 3.
It is further submitted that wife of petitioner is alone at home and there is no other person who can look after her. He prays for grant of 07 days of interim bail, in order to enable him to ensure that she gets proper treatment.

look after the wife of the petitioner. She further submits that petitioner is involved in serious offences under NDPS Act and 260 grams of heroin was recovered from the possession of the petitioner. He is a flight risk and therefore, does not deserve the leniency of bail. 5.
The learned APP produces the opinion of Doctor, which is taken on record. The Doctor has confirmed that the wife of the petitioner is suffering from Hypertension, Seizure Disorder and headache for about 1.5 months. 6.
Since, the wife of the applicant is suffering from seizure disorder, on humanitarian consideration, he is granted interim bail for a period of 07 days from the date of his release, subject to the petitioner furnishing a personal bond in the sum of Rs.30,000/- with a surety of like amount to the satisfaction of the concerned Trial Court/Duty Magistrate. 7.
The order is subject to the condition that petitioner shall not seek extension of bail on any ground whatsoever and shall surrender before the Superintendent Jail immediately on completion of interim bail period and shall report at 4:00 PM at the Office of Narcotics Cell, Darya Pur everyday and in case of non-compliance, the interim bail shall automatically stands cancelled.
