This application is, accordingly, disposed of. BAIL APPLN. 2400/2019 Vide the present application, the applicant/ accused seeks directions thereby to release him on bail in case FIR No. 449/2018 registered at PS - Ranhola, Outer District, Delhi for the offences punishable under Sections 392/397/34 IPC.

The case of the petitioner is that the petitioner was arrested on 28.06.2018 and out of the three accused persons, one is absconding and another accused is in Judicial Custody since then.

Learned counsel for the applicant submits that no recovery has been made from the applicant whereas, out of Rs.1,600/- robbed in the present case, the recovery of Rs.1,100/- is from the co-accused. Learned APP appearing on behalf of the State has opposed the present application and submits that the applicant and the co-accused caught the victim and on showing knife they robbed an amount of ₹1,600/- from the complaint.

It is not disputed that the total witnesses are ten and till date only two witnesses have been examined. The applicant is in jail since 28.06.2019. In view of the above, taking into account the fact that the trial shall take substantial time, this Court is inclined to suspend the sentence of the applicant.

Let the applicant be released on bail on his furnishing personal bond in the sum of ₹20,000/- with one surety of the like amount to the satisfaction of the Trial Court.

The application is allowed and disposed of.

Copy of this order be transmitted to the Jail Superintendent and the Trial Court concerned for compliance.
