The applicant seeks regular bail in case arising out of FIR No. 0370/2024 dated 01.06.2024, registered at P.S. Begum Pur, for commission of offences under Section 376 IPC and Section 6 of Protection of Children from Sexual offence Act, 2012 (POCSO Act).

He is in custody for now around approximately two years and it is informed that the child-victim as well as her parents have already been examined.

Learned APP for the State submits that since the material witnesses have been examined, every effort would be made to ensure that the remaining witnesses, who are more or less formal in nature, are also examined without any delay.

After hearing arguments for some time, learned counsel for the applicant seeks to withdraw the present application with liberty to file application afresh in case the trial is not concluded within a period of six months from today.

This Court is not oblivious of the fact that the applicant was hardly 22 years of age when arrested and during course of the arguments learned counsel for the applicant submitted that the alleged relationship was consensual in nature and there is delay in lodging the FIR, which was registered only when the family of child-victim learnt that she was in a family way.

Be that as it may, in view of the above, the present petition is disposed of, as not pressed.

All rights and contentions of the parties are reserved. 8.
The learned Trial Court is requested to make earnest effort to dispose of the case within a period of six months.

In case, the matter is not disposed of within the abovesaid time-frame, the applicant would be at liberty to file application seeking bail, directly, before this Court.
