O R D E R

% 27.11.2019 By way of the present application, petitioner seeks bail in FIR No.214/2019 dated 13.04.2019 under section 375/506 IPC read with Section 6 of the POCSO Act registered at P.S.Vasant Kunj (South), District-South West Delhi.

It is not disputed that the alleged incident took place on 15.09.2018 however, the prosecutrix disclosed the same to her mother on 16.09.2018. Thereafter, till February, 2019 no complaint was filed and the FIR mentioned above came to be filed only on 13.04.2019. It is also not disputed that as per MLC of the prosecutrix, there is no sign of penetration. The petitioner is in judicial custody since 13.04.2019. In view of the fact that charge sheet has already been filed and trial shall take its own time, I hereby direct that the petitioner be released on bail, subject to his furnishing personal bond in the sum of ₹15,000/- with one

surety of the like amount to the satisfaction of the Trial Court and further subject to the following conditions:- a. That he shall not come in contact with or try to influence any of the witnesses connected with the case either directly or indirectly; b. That he shall not misuse the concession of interim bail granted to him; c. In case of change of his address, the same shall be brought to the notice of the IO/SHO in writing.

The bail application stands disposed of accordingly. Copy of this order be sent to the Jail Superintendent concerned for necessary compliance.
