% 03.02.2017 CM No.976/2017 (exemption) Exemption allowed, subject to all just exceptions. RC.REV. 12/2017 & CM No.975/2017 Learned counsel appearing for the petitioner submits that he has discussed the matter with the respondent and it has been agreed that he will vacate the tenanted premises as described in the Eviction Petition within nine months from today i.e. on or before 3.11.2017. He will file an undertaking to the said effect by means of an affidavit of the petitioner. The undertaking shall also incorporate that the petitioner shall continue to pay the agreed rent for the entire period of occupation. The petitioner shall also undertake to pay the electricity and water charges payable for the period under occupation of the petitioner. The petitioner shall also undertake not to part with possession of the property or cause any wilful damage to the property.
In view of the above, learned counsel for the petitioner submits that he does not press the present revision Petition.
Learned counsel appearing for the respondent submits that in case the above undertaking is filed by the petitioner within two weeks from today the respondent shall not execute the eviction order till 3.11.2017. Undertaking be filed within two weeks from today.
Petition stands disposed of. All pending applications, if any, also stand disposed of.
