The petitioner has filed the present petition, inter alia, impugning an order dated 24.10.2019 rejecting the petitioner's request to be released on furlough on a cash security, instead of two sureties as stipulated by the competent authority.

The learned counsel for the petitioner points out that he was released on parole pursuant to an order dated 14.09.2018 passed by this Court in W.P. (Crl.) No. 2415/2018 captioned 'Jabbar Singh v. State'. However, the petitioner could not furnish the surety bond for a sum of ₹25,000/- and the same was reduced to ₹10,000/- by an order dated 12.12.2018 passed in the said petition. Thereafter, the petitioner filed another application seeking that

he be released on cash surety as he was unable to furnish a surety bond. The said application was allowed by an order dated 25.02.2019. The petitioner was released on providing cash security and there is no allegation that he has misused the same.

In view of the above, this Court considers it apposite to allow the present petition. The respondents are directed to release the petitioner on furlough on his providing cash security in the sum of ₹10,000/-. It is clarified that all other terms and conditions as stipulated in the order dated 29.07.2019 (the order by virtue of which petitioner's application for furlough was allowed) are applicable and are required to be complied with. 4.

The petition is allowed in the aforesaid terms. 5.

The Registry is directed to communicate this order to the petitioner through the concerned Jail Superintendent.
