Vide the present petition under Section 482 of the Cr P C, petitioner seeks direction thereby quashing of the FIR / RC No.1/83SIU-1 dated 22.03.1983 and the proceedings emanating thereform against him.

Vide order dated 24.08.2015, this Court directed to file status as to how many witnesses have been examined by the respondent during trial.

Pursuant to said order, Ms.Sonia Mathur, learned Standing Counsel for CBI submits that initially the CBI had cited 117 prosecution witnesses, however, thereafter, it is decided to examine only 36 witnesses. She further informs that 35 witnesses have already been examined and the last witness i.e. Investigating Officer CRL.M.C. 81/2012

is being examined through the video conferencing. Thus, she submits that trial is at the fag end of conclusion.

In view of the facts recorded above, I am not inclined to pass any further orders in the petition at this stage. However, the petitioner is at liberty to take his defences in the statement which will be recorded under Section 313 of the Cr P C and by leading evidence in defence.

In above terms, instant petition is disposed of. Crl.M.A.Nos.315/2012 and 5016/2015 Dismissed as infructuous.
